By accessing and using DwellChecker ("Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to these terms, please do not use our Service.

2. Description of Service

DwellChecker provides real estate market intelligence reports and analysis tools ("Service"). The Service includes:

• Free Tier: 3 monthly credits for basic ZIP code market reports with sample data
• Verified Feedback Tier: Enhanced access (10 credits/month) earned through quality feedback
• Premium Services: Paid subscription or one-time reports with enhanced features
• Credit System: Users can earn credits by providing quality feedback

3. User Accounts

3.1 Account Creation

To access certain features, you may need to create an account. You agree to:

• Provide accurate and complete information
• Maintain the security of your password
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized access

3.2 Account Termination

We reserve the right to terminate or suspend accounts that violate these terms or engage in fraudulent activity.

4. Credits and Freemium Model

4.1 Credit System

Users earn and spend credits as follows:

• Free Tier: 3 credits per month, auto-reset monthly
• Earning Credits: 1-3 credits per quality feedback submission
• Spending Credits: 1-6 credits per report depending on type
• Credit Expiration: Unused monthly credits expire at reset; bonus credits do not expire

4.2 Tier Upgrades

Users who submit 5+ quality feedbacks automatically upgrade to Verified Feedback tier (10 credits/month).

5. Data and Reports

5.1 Data Accuracy

We strive to provide accurate information, however:

• Free Tier: Reports use sample data for demonstration purposes only
• Premium Tier: Reports use real-time data when available but accuracy is not guaranteed
• Data is provided "as is" without warranties of any kind
• We are not liable for decisions made based on our reports

5.2 Not Financial Advice

DwellChecker reports are for informational purposes only and do not constitute financial, legal, or real estate advice. Always consult with qualified professionals before making real estate decisions.

6. Payment Terms

6.1 Premium Services

Premium services are provided on a subscription or one-time payment basis:

• Monthly Subscription: $49/month, auto-renews until cancelled
• One-Time Reports: $99-$199 depending on report type
• Payment Processing: Via Stripe secure payment processing

6.2 Billing

• Subscriptions auto-renew unless cancelled 24 hours before renewal
• You authorize us to charge your payment method on file
• Prices subject to change with 30 days notice
• No refunds for partial months on monthly subscriptions

8. User Conduct

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorized access to our systems
• Submit false or misleading feedback to earn credits
• Share your account credentials with others

• Use automated systems to access the Service

9. Intellectual Property

All content, features, and functionality of the Service are owned by DwellChecker and protected by copyright, trademark, and other intellectual property laws. You may not:

• Reproduce or redistribute our content
• Create derivative works
• Remove copyright or trademark notices

10. Feedback and User Content

By submitting feedback, bug reports, or feature requests:

• You grant us a perpetual, worldwide license to use your submissions
• You represent that you own or have rights to the content
• We may use your feedback to improve our Service
• Credit rewards are at our discretion based on quality

12. Disclaimers

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Merchantability or fitness for a particular purpose
• Accuracy, reliability, or availability of data
• Uninterrupted or error-free operation
• Security of your data

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DWELLCHECKER SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, or consequential damages
• Loss of profits, data, or goodwill
• Damages resulting from use of or inability to use the Service
• Any amount exceeding $100 or the amount you paid us in the past 12 months

14. Indemnification

You agree to indemnify and hold harmless DwellChecker from any claims, damages, or expenses arising from:

• Your use of the Service
• Violation of these Terms
• Infringement of any third-party rights

15. Modifications to Service

We reserve the right to:

• Modify or discontinue any part of the Service
• Change pricing with 30 days notice
• Update these Terms at any time
• Continued use after changes constitutes acceptance

16. Termination

Either party may terminate this agreement:

• By You: Cancel subscription or delete account at any time
• By Us: Terminate access for violation of terms or suspected fraud
• Upon termination, you lose access to credits and reports

17. Dispute Resolution

17.1 Informal Resolution

17.2 Arbitration

Any disputes not resolved informally shall be settled by binding arbitration in accordance with the rules of the American Arbitration Association.

17.3 Class Action Waiver

You agree to resolve disputes individually and waive any right to participate in class action lawsuits.

18. Governing Law

These Terms shall be governed by the laws of the State of Massachusetts, United States, without regard to conflict of law provisions.

19. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.
